Article 1. Applicability

1.1 These General Terms and Conditions (hereinafter: conditions) apply to all offers, orders and agreements of Lord of the SHORTBOX COMICS (hereinafter: SHORTBOX COMICS), to the exclusion of any other general terms and conditions.

1.2 Deviations from these conditions are only valid if agreed in writing, in which case all other provisions remain fully in force.

1.3 Placing an order implies that you unconditionally accept these conditions.

Article 2. Agreement and Website Offers

2.1 All offers from SHORTBOX COMICS are non-binding and SHORTBOX COMICS expressly reserves the right to change prices.

2.2 An agreement is established only after your order has been accepted by SHORTBOX COMICS. SHORTBOX COMICS is entitled to refuse orders or to attach certain conditions to the delivery unless explicitly stated otherwise.

Article 3. Delivery

3.1 Delivery times provided by SHORTBOX COMICS are indicative. Exceeding any delivery time does not entitle you to compensation or cancellation of the order or termination of the agreement, unless the delay is such that you cannot reasonably be expected to maintain the agreement. In that case, you are entitled to cancel the order or terminate the agreement insofar as necessary.

3.2 Delivery of products takes place at the moment and location at which the products are ready for shipment to you.

3.3 You must provide a correct address for delivery. If you fail to do so and the order cannot be delivered, any additional shipping costs are at your expense.

3.4 If you want your order delivered outside the Netherlands, please provide your email address and telephone number so the carrier can contact you if needed.

Article 4. Prices and Payments

4.1 All prices for products and services are listed in euros, including VAT and excluding handling and shipping fees, taxes or other charges, unless otherwise stated or agreed in writing.

4.2 Payments through the webshop must be made immediately at the time of purchase.

4.3 Payment can be made via credit card, PayPal, Klarna, iDEAL, BanContact, or bank transfer in both Belgium and the Netherlands. Orders through the webshop must be paid immediately unless you use the CLAIMCOMIC code.

4.3.1 When using this code during checkout, comics will be reserved and acceptance of the offer, including payment, will be postponed until the end of the month. This allows you to accumulate products from the website or our live events. We also refer to this as stacking.

4.3.2 A saving and reservation system that allows customers to save on shipping costs by reserving and accumulating their orders. The customer indicates an intention to purchase. The actual offer and acceptance occur later: during invoicing (offer) and payment (acceptance).

4.3.3 These stacked products will be reviewed with you at the end of the month and, after acceptance of the offer, processed through the website. Our payment term is 14 days.

4.4 If you fail to meet any payment obligation, SHORTBOX COMICS is entitled, without notice, to suspend or terminate the execution of the agreement, without prejudice to its other rights.

Article 5. Retention of Ownership

5.1 Ownership of delivered products is transferred only when you have fulfilled all obligations arising from the agreement with SHORTBOX COMICS. The risk relating to the products transfers to you at the moment of shipment.

Article 6. Intellectual and Industrial Property Rights

6.1 You must fully and unconditionally respect all intellectual and other proprietary rights regarding the products supplied by SHORTBOX COMICS.

6.2 SHORTBOX COMICS does not guarantee that the products delivered to you do not infringe any (unwritten) intellectual and/or industrial property rights of third parties.

Article 7. Complaints and Liability

7.1 You are required to inspect the products upon receipt and to notify Shortbox Comics of any visible defects or non-conformities without undue delay and, where reasonably possible, within seven (7) working days after delivery.

7.2 If a product does not conform to the agreement, Shortbox Comics may, at its discretion, replace the product, offer a suitable alternative, or refund the purchase price.

7.3 Consumers have a statutory right of withdrawal of fourteen (14) days, unless an exclusion applies as set out in Article 14. During this period, the consumer may handle and inspect the product only to the extent necessary to assess its nature, characteristics, and functioning.

7.4 If the returned product shows signs of use beyond what is necessary for inspection, Shortbox Comics reserves the right to apply a depreciation or refuse a full refund, in accordance with applicable consumer legislation.

Article 8. Orders/Communication

8.1 SHORTBOX COMICS is not liable for any damage, delay, or improper processing of orders and communications resulting from the use of the Internet or any other communication medium between you and SHORTBOX COMICS, or between SHORTBOX COMICS and third parties, as far as related to the relationship between you and SHORTBOX COMICS, unless caused by intent or gross negligence.

Article 9. Force Majeure

9.1 In the event of force majeure, SHORTBOX COMICS has the right to suspend execution of your order or terminate the agreement without judicial intervention, without being liable for damages, unless this would be unacceptable under standards of reasonableness and fairness.

Article 10. Miscellaneous

10.1 Many products display a catalog image, meaning it is supplied by the distributor. Minor deviations may occur.

10.2 If you provide SHORTBOX COMICS with a written address, SHORTBOX COMICS is entitled to send all orders to that address unless you provide another address in writing.

10.3 If SHORTBOX COMICS has allowed deviations from these conditions, whether temporarily or permanently, this does not affect its right to demand strict compliance at any time. You cannot derive any rights from lenient application of these conditions.

10.4 SHORTBOX COMICS is entitled to use third parties in executing your order(s).

10.5 SHORTBOX COMICS reserves the right to modify these conditions at any time.

Article 11. Applicable Law and Competent Court

11.1 Dutch law exclusively applies to all rights, obligations, offers, orders and agreements to which these conditions apply.

11.2 All disputes will be submitted exclusively to the competent court in the Netherlands.

11.3 SHORTBOX COMICS aims to minimize waste. For this reason, we do not use printed packing slips or paper invoices. All information is provided digitally via email or through the website.

Article 12. Shortbucks Loyalty Program

12.1 Shortbucks are loyalty points that may be earned through qualifying purchases and promotional activities at Shortbox Comics. The program is offered as a customer benefit and has no independent monetary value.

12.2 Shortbucks may only be redeemed for discounts, applicable products, or other benefits explicitly offered by Shortbox Comics.

12.3 Shortbucks are not exchangeable for cash, credit, gift cards, or any other form of monetary or non-monetary value, and cannot be paid out under any circumstances.

12.4 Shortbucks are personal, non-transferable, and may only be used by the account holder within Shortbox Comics.

12.5 Shortbucks cannot be combined with other discounts or promotional offers, unless explicitly stated otherwise.

12.6 In the event of a return, cancellation, chargeback, or partial refund, the corresponding Shortbucks will be revoked in full or in part.

12.7 Shortbox Comics reserves the right to modify, suspend, or terminate the Shortbucks program, including its structure, conditions, and redemption options, at any time and without prior notice.

12.8 In cases of suspected misuse, fraud, or abuse, Shortbox Comics reserves the right to revoke Shortbucks and exclude a customer from participation in the program.

12.9 Shortbox Comics reserves the right to restrict, suspend or revoke access to the Shortbucks program, shipping benefits, stacking options, or other customer loyalty features in cases of abuse, excessive operational burden, prior financial damage, fraudulent conduct, unreasonable claim behavior, or other conduct deemed harmful to the business operations of Shortbox Comics.

12.10 Shipping benefits redeemed through the Shortbucks program are intended for combined stack shipments only. Customers may use Shortbucks for free shipping a maximum of two (2) times per calendar month, unless explicitly approved otherwise by Shortbox Comics.

Shortbox Comics reserves the right to refuse excessive partial shipments, limit shipping benefit usage, or require standard shipping payment in cases where shipment requests create disproportionate operational workload, repeated small parcel handling, or unreasonable use of the stacking and loyalty system.

Article 14. Exclusions from the Right of Withdrawal

The right of withdrawal does not apply, insofar as permitted by law, to the following products:

• Pre-orders and special orders for products with a future release date that are ordered specifically for the customer and are subject to limited availability, market sensitivity, or publisher allocation.
• Mystery bags and blind bags, where the contents are unknown at the time of purchase and form an inseparable set.
• Products that have been opened, used, read, or otherwise handled beyond what is necessary to assess their nature and condition.
• Products that are no longer in their original condition due to customer handling.

These exclusions are applied in accordance with applicable European consumer protection legislation and the collectible nature of the products.

Article 15. Product Condition and Images

All new comics sold by Shortbox Comics are brand new and typically in Near Mint condition (approximately NM 9.4–9.8), unless stated otherwise.

Raw comics are generally offered in high grade, with an average condition of VF/NM. If a comic is in a lower condition, this will be clearly mentioned in the product title or description.

Minor distributor or printing defects such as small spine ticks, corner dings, or printing imperfections are considered acceptable and do not constitute a defect.

Catalog images are supplied by publishers or distributors and are always indicative and non-binding. Minor deviations in cover appearance may occur.

Article 16. Pre-orders and Availability

Pre-orders are placed approximately two months prior to release and become binding at the moment of ordering and when the comics are ordered through our pull list with distributors.

Pre-orders cannot be cancelled as a standard policy. In exceptional cases, cancellation may be discussed in consultation with Shortbox Comics.

If a pre-ordered product is cancelled by the publisher or becomes unavailable, the order will automatically lapse. Shortbox Comics is not always proactively informed of such cancellations.

In such cases, the customer may contact Shortbox Comics to inquire about possible reprints. If the product is offered again, it must be placed as a new order.

In the event of non-delivery, the customer may choose between a refund or store credit.

Article 17. Shipping, Risk and Transport Damage

17.1 Orders are deemed shipped once they are handed over to the carrier for transport.

17.2 For consumer purchases, the risk of loss or damage to the products remains with Shortbox Comics until the products have been delivered to the consumer or a designated third party, in accordance with applicable consumer law.

17.3 In the event of loss or damage during transport, Shortbox Comics will investigate the matter and handle any claims with the carrier on a case-by-case basis.

17.4 Shipments are not insured as a standard policy, unless explicitly agreed otherwise in writing.

Article 18. Payment, Stacking and Late Payment

Stacking is a reservation system in which comics are temporarily reserved. The actual offer and acceptance occur at the moment the monthly invoice is issued and subsequently paid.

Invoices are sent in the first week of the new month. The formal payment term is 14 days, although payment within 1–7 days is preferred to enable efficient bulk shipping.

Shortbox Comics may determine, at its sole discretion, whether orders are combined into a single shipment or shipped separately. Shipping methods, shipment timing, and the use of shipping vouchers or loyalty benefits may be limited or refused in cases of operational necessity, misuse, excessive shipment frequency, or prior account issues.

If payment is not received within the payment term, Shortbox Comics reserves the right to:

• Send payment reminders by email and WhatsApp.
• Temporarily suspend access to PreorderComics.nl and claim groups.
• Cancel stacked or reserved items.
• Revoke earned Shortbucks.
• Return reserved items to stock and offer them for sale again.

Article 19. Accounts and Shortbucks

Shortbox Comics reserves the right to suspend or terminate customer accounts on PreorderComics.nl and, if necessary, ShortboxComics.nl in cases of misuse, fraud, or persistent non-payment.

In the event of account suspension or closure, Shortbucks will remain valid and may be converted into discount vouchers or shipping vouchers for use in the webshop, subject to approval and on a case-by-case basis.

The maximum stacking period without payment is one month, unless otherwise agreed.

Article 20. Limitation of Liability and Language

The liability of Shortbox Comics is limited to a maximum amount of €500 per invoice, unless mandatory law provides otherwise.

Shortbox Comics is not liable for indirect or consequential damages, including but not limited to loss of profit or missed savings.

In the event of translations of these terms and conditions, the English version shall prevail.
